Taxes

The Brevard County Sheriff’s Office is exempt from the payment of all federal excise taxes and sales taxes of the State of Florida.  The tax exempt number is 85-8012621752C-1 and is valid 4/30/2023 – 4/30/2028.  (BCSO Tax Exempt Form)

Bid Submittals

All responses to Invitations to Bid (ITB) or Requests for Proposal (RFP) must be submitted in a sealed envelope and identified as indicated in the solicitation specifications.  These may be delivered by mail or in person.  All bids will be opened publicly on the date and time indicated in the specifications.  Bids received after the specified date and time will not be eligible.

The Evidence Unit is the central repository for all property and evidence held by the Sheriff’s Office relating to criminal and non-criminal matters. The main function of the Evidence section is to provide for the security and control of recovered and evidentiary property as well as abandoned, lost, or found property in the custody of this agency. This is critically important in supporting investigations, helping to guarantee successful prosecution at criminal or civil trials and facilitating the timely return of property to its rightful owners.

Property Claims and the Release of Property/Evidence

The ability to return property or evidence depends on several factors, to include; the type of property/evidence, the circumstances or reasons why the Sheriff’s Office has possession of it, and the inability of the item to be possessed by the owner.

In order to pick up any property:

  • Call and schedule an appointment with the Evidence Unit (321-264-5211). Please have a case report number prior to calling, if possible, to assist with this process. Personnel will need to verify with a case Agent or the State Attorney’s Office if items are releasable prior to setting an appointment.
  • If the owner chooses to have a designee pick-up their property, the designee must have a document that has been signed by the owner and notarized, explaining they have written authorization to pick up the property.
  • The owner, or designee, picking up any property or firearms must bring a valid state issued license, ID card, or passport which contains a photograph, in order to have items released to them.
  • Firearms will not be released to a convicted felon.


    Prior to any firearms being released, a criminal history will be done on the person designated to pick it up, in order to determine if there are any prior felony convictions, or any other information which would indicate the firearm could not be released to the person. If there are any questions as to the adjudication of a charge(s), or any other information questioning the ability of the person to be in possession of a firearm, the weapon will not be released until it is resolved. If a person picking up the firearm has been convicted of violating FS 790.07, or was convicted of any misdemeanor battery domestic violence charge pursuant to federal law, Title 18 USC Section 922(g)(9), the firearm cannot be released to the person, as it is against the law for them to be in possession of or own a firearm.

    Please call the Evidence Unit ahead of the scheduled appointment time with the information of the person picking up the firearms, as it can take approximately 30 minutes or more to perform the required criminal history/background check.

  • The reason for not being able to release a firearm/property is partially based on the factors in which it was taken into custody. Some of these reasons include, but are not limited to: Evidence, Court Ordered Domestic Violence Injunction, Baker Acts, and Ex Parte Actions.

Judicial Process Unit

The Judicial Process Unit is responsible for fulfilling the Sheriff’s constitutional responsibilities as the keeper of Criminal and Civil Process. The Civil Unit is charged with the statutory responsibility of serving and returning the judicial process and enforcing judgments and orders.

Any civil process received with incorrect paperwork will be returned.

  • Personal Property: Office Furnishings; Businesses: Price To Be Determined On Quantity Of Items Being Levied. An Inventory List Will Need To Be Seen Before An Amount Is Determined. ** Larger Boats, Heavy Equipment Etc., To Be Determined On the Situation.

Petitioner: How do I find out if an injunction has been served?

Please do not call our agency to find out if an Injunction has been served. These cases are confidential and we cannot release information over the phone.

  • During Normal Business hours.

The Petitioner can go to the closest Law Enforcement agency or the Clerk of the Court with a photo ID in person to find out if the injunction has been served.

  • After Hours/Weekends/Holidays

The Petitioner can call the non-emergency number and arrange to meet with a Law Enforcement officer to assist in finding out if the injunction has been served or not. The petitioner must have a photo ID in person to present to the Law Enforcement Officer.

Where can I obtain legal forms and information for filing a civil court case?

Legal forms can be located on the Clerk of Courts website under forms or visit any Clerk of Courts Office in person. www.BrevardClerk.us

You can obtain an eviction packet in person from the Brevard County Clerk of the Court and it will explain the process for Eviction. You can also obtain this information online at www.BrevardClerk.us

The Sheriff’s Office cannot intervene on either party’s behalf unless a threat of violence has occurred or a crime has been committed against the involved parties. Referral information is available through the Landlord Tenant Citizen Dispute Program at 1-800-435-7352 (1-800-HELP-FLA) or www.fdacs.gov/Consumer-Resources/Landlord-Tenant-Law-in-Florida, Landlord / Tenant Law.

Some of the most common reasons that it takes so long for service are:

  • Inadequate or incomplete address information.
  • Not supplying an employment address and a telephone number.
  • No service instructions included.
  • No information for return of service.
  • No contact telephone number for you provided on Writs of Possession.
  • Delivery of Paperwork to a satellite office or main office and paperwork has to travel between offices.

Once the process has been “served” or “not served”, a return of service is mailed to the plaintiff /the plaintiff’s attorney at the address provided. The plaintiff can also call the Judicial Process Unit at (321) 264-5207 to request a service check.

  • Service address is not located in Brevard County.

  • The Court Seal is missing. Clerk has not signed or initialed, Original signature is missing.
  • Alias/Pluries must be issued. Re-file original with appropriate Clerk of the Courts office.
  • Sheriff’s non-refundable fee to be paid in advance per Florida Statute 30.231. Business check or money order must be payable to Brevard County Sheriff in the exact amount.
  • No personal checks accepted.
  • Check not signed.
  • Check not properly completed.
  • Cost Deposit not submitted or not correct amount.
This type of civil summons requires personal service by Florida State Statute and can lead to service delays if filed together. The landlord or agent can separate these actions, which in return can speed up the eviction process by allowing the 5-Day Eviction summons to be posted after two (2) separate attempts within a 6-hour time frame.
According to Florida Rules of Procedure and State Statute you cannot count the weekends and holidays in the 24-hour time calculation. The Sheriff’s Office does not serve on weekends or legal holidays. If the Deputy is having difficulty contacting you, this will delay the process.
You should contact the Sheriff’s Office within the county and state where the person or business resides so they can be served. The Clerk’s office within that county may also be able to assist you.
